General

By downloading the Mobile Digital Application (App) to your mobile device, you agree that you have read and understood these Terms and Conditions and are bound by them. You consent to Epic Vouchers Pty Ltd ABN 36 645 411 114 (Epic) collecting, using and disclosure of your personal information in accordance with our Privacy Policy.

The barter, trade, sale, purchase, publishing, or transfer of the App or any of its offers and merchant redemption codes, by any person or entity, including but not limited to travel services, travel providers, and printers, third party websites, publishers, and distributors of the App or any of its Vouchers, is strictly prohibited, unless expressly authorised by Epic. All offers on the App are subject to these Terms and Conditions.

Defined Terms

Purchase Date: The date that the Package is purchased.
Package: The Package of Vouchers that is offered by Epic.
Customer: A person who has purchased a Package.
Vendor: A Vendor that has offered Vouchers as part of a Package.
Voucher: An offer by a Vendor that permits the Customer to redeem a Voucher with the stated offer. Offers may change from time to time without notice. A Voucher is not transferrable or redeemable for cash.

Purchasing of packages

Purchase of the Package is made securely with a credit card. The charge will appear on your credit card statements as ‘Epic Vouchers’.

All costs in Australian dollars and are inclusive of GST.

All Vouchers and the Vendors that provide those Vouchers are subject to availability and their continued operation. We cannot accept any responsibility for any products, services, or promotions that are discounted, sold out or temporarily unavailable or Vendors that are no longer in business.

These Terms and Conditions are governed by and will be construed in accordance with the laws of Australia.

Customers purchase a Package through the App. The Vouchers are valid for 365 days from the date of purchase. Vouchers can be redeemed at any time during that period. Whilst every effort is made to ensure that the Vendors continue to make the discounts available, we cannot be held responsible where the Vendor chooses to remove their Voucher from our Package. Customers will have access to any Voucher within any category however they only have access to the number of Vouchers that they have purchased with that Package.

Packages, Vendor products and pricing are subject to change from time to time.

Customers must provide a valid email address and mobile number and create a unique password when purchasing a Package. It is the Customers are responsible for maintaining the secrecy of their password and can change it at any time. Epic takes no responsibility for any loss arising from unauthorised use of a Customer’s password or a Customer’s failure to comply with these provisions.

Access to Package you have purchased can be revoked by Epic Pty Ltd at any time, in its sole discretion and without compensation, for any reason including but not limited to abuse or breach of any of the Terms and Conditions of the Program, any actions deemed by Epic to be contrary to interests of the company, the interests of its Vendors, other customers or in the case of fraud or misuse.

Epic assumes no liability whatsoever, including without limitation, liability for any expense, loss, cost, injury, damage, accident or any other matter or thing whatsoever, however suffered or caused (including compensatory, incidental, indirect, special, punitive, consequential or exemplary damages or damages for loss of income or profits), directly or indirectly arising out of or related to the Package or by reason of the termination of or amendment to the Package in whole or in part, the value or availability of Vouchers, or the addition or deletion of Offers, participating Vendors or other features with or without notice.

Neither Epic nor its respective officers, agents, employees and related bodies corporate shall be responsible for any failure of the epicvouchers.com.au website, or Epic App for any problems or technical malfunction of a telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any e-mail, online or Internet entry, technical problems, traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to any computer or property related to or resulting from participating in or downloading any material relating to the Package. Epic reserves the right, at its sole discretion, to cancel or suspend this App should a virus, bug or any other cause beyond the reasonable control of the company corrupt the security or proper administration of the Package.

Any attempt to deliberately damage any website or app or to undermine the legitimate operation of the Package is a violation of criminal and civil laws and should such an attempt be made, Epic reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

Upon expiry of the Package or the use of all Vouchers, customers will be invited to pay for a new Package.

Returns Policy

Unfortunately, we are unable to refund you if you have a change of mind once you have purchased the Package.

Marketing, Promotions and Personal Information

By purchasing a Package, customers will be automatically enrolled into and consent to, receiving marketing communication. It is the responsibility of the Customer to opt-out of receiving email communications by selecting unsubscribe on the email footers. Customers are responsible for keeping the information in their account up to date including by not limited to their name, e-mail address, mobile phone number.

Vouchers

Vouchers are only available at participating Vendors and may vary between similar Vendors. Offers are for personal use only, and cannot be assigned, traded, or otherwise transferred in accordance with the Terms and Conditions of the use of the Package. Any assignment or transfer in violation of these rules will be void, and may, at the sole discretion of Epic, result in the cancellation of your Package.

Privacy

Please refer to the Privacy Policy for addition information. Epic and its respective officers, agents, employees, and related bodies corporate (collectively, “we” or “our”) are committed to protecting your privacy. We collect your personal information for the following purposes to:

  • set up and administer the Package including ongoing management of your accounts.
  • facilitate or enable any corporate or commercial transaction involving Epic
  • process and issue Vouchers;
  • communicate with Customers;
  • understand Customer requirements;
  • provide Customers with marketing material.

Epic will obtain consent before using personal information for a purpose that has not been specified unless the new purpose is required by law. Epic may share aggregated and anonymous Customer data with third parties so long as that information reasonably traced back to an individual. Customer information is considered an Epic asset.

Termination, Changes and Breach

Epic may change these Terms and Conditions, any aspect of the Package including redemption procedures or any Vouchers in any respect, all without notice and even though changes may affect the value of Epic Packages already purchased.

General

These Terms and Conditions constitute the entire agreement between you and Epic regarding your purchase of a Package, your entitlement to redeem Vouchers within the Package and supersede all previous versions. Except as expressly contained in these Terms and Conditions, there are no conditions, representations, warranties, express or implied, statutory, or otherwise. When you deal with Epic or its respective officers, agents, employees, and related bodies corporate over the Internet, you consent to the formation of contractual relations through electronic communications. Epic has the final authority as to the interpretation of these Terms and Conditions and as to any other questions or disputes regarding the Package.

Changes to these Terms and Conditions

Epic reserve the right to change, suspend or terminate these Terms and Conditions at any time. Where Epic changes these Terms and Conditions, or any Vouchers under the Package, an updated copy of these Terms and Conditions will be available on the App.
